Terms of Service

These terms are between you (the venue) and TO SET — legal entity name ("Cue", "we"). By creating an account you accept them.
What Cue is
Cue is point-of-sale and floor-management software delivered over the web: tables, orders, kitchen tickets, reservations, waitlist, menu, staff and reports. Cue is not a bank, a payment processor, or a money transmitter. We never take custody of your money.
Your account
You are responsible for what happens under your account, for the staff accounts you create, and for the roles you give them. Keep credentials private and tell us promptly at [email protected] if you think an account has been compromised. You must be old enough to enter a contract, and you must use Cue for a lawful business.
Your data is yours
Your menu, your tables, your orders and your guest records remain yours. We claim no ownership. We use them to provide the service and to keep it working — nothing else. We do not sell them, and we do not mine them to build products for anyone else. Handling is described in our Privacy Policy.
Guest data and messaging
When you enter a guest's details you are the controller of that data and we process it for you. You are responsible for:
- having a lawful basis for holding it;
- obtaining consent before entering a phone number that Cue will text; and
- complying with the TCPA and equivalent state law.
We provide the STOP and HELP handling required by US carriers. We cannot provide the consent — only you can.
Payments
Guests paying you
Card payments run through Stripe into your Stripe account. Your relationship for those funds is with Stripe, on their terms. Payout timing, fees, chargebacks and disputes are between you and Stripe. Cue never holds the money and cannot release, reverse or expedite a payout.
You paying us
Cue is sold as a subscription per venue, billed in advance, with unlimited devices and staff accounts on any plan. Pricing is not final at the time of writing — you will be shown the price and asked to confirm before you are ever charged, and no charge happens without that. Subscriptions renew until cancelled; cancel any time and you keep access to the end of the period you have paid for.

Availability, and what Cue needs to work
Cue requires an internet connection. If your connection drops, Cue cannot send orders, fire tickets or take payments until it comes back. There is no offline mode today. We are saying this in the contract as well as on the website because it is the thing most likely to affect your service.
We aim to keep Cue available and will give notice of planned maintenance where we can, but we do not offer a service-level agreement or an uptime guarantee, and Cue is provided "as is". Keep a fallback for taking payment — a card terminal, or paper — as you would with any POS.
Acceptable use
Do not use Cue to break the law, to store data you have no right to hold, to attempt to access another venue's data, to probe or overload the service, or to resell it as your own product.
Suspension and termination
You can close your account at any time. We may suspend or close an account that breaches these terms, that is being used unlawfully, or where payment has failed and stayed unresolved — for anything other than an urgent safety or legal issue we will contact you first. On closure you may export your data for TO SET — export window before it is deleted.
Liability
To the fullest extent the law allows, Cue is not liable for indirect or consequential loss, for lost profits or lost revenue, or for lost data beyond our duty to maintain reasonable backups. Our total liability in any twelve month period is limited to what you paid us in that period.
Nothing here excludes liability that cannot be excluded by law.
Changes
We may update these terms. For material changes we will email account holders before they take effect. Continuing to use Cue afterwards accepts the new terms.
Governing law
These terms are governed by the laws of TO SET — state, United States, and the courts of that state have exclusive jurisdiction.
